criminal procedure code, 1898 (v of 1898) - 3s 30 & '2- owning or possessing heroin -offence of - conviction --- magistrate 1st class-trial by-validity of-challenge to- more than 10 grams of heroin allegedly secured from accused - held : magistrate; 1st class not to be empowered even to take cognizance of such case punishable with imprisonment for life) -magistrate trying and convicting aossllant for possessing 30 grams of heroin and 20 grams of opium not describing himself as magistrate empowered under s 30 of cr p. c -held : sentence of 5 years k. i. passed by such magistrate to be null and void.
