PETITION  FOR WITHDRAWAL OF SUIT

Respectfully Sheweth:-

1.    That the Petitioner / Plaintiff has filed the above captioned suit which is pending            in this Honourable Court and is fixed for 31.09.2015.  

2.    That the Petitioner / Plaintiff has effected compromise with her husband (i.e. the Defendant) with her free will and consent and now a days the Petitioner / Plaintiff being legally wedded wife is residing with her husband (i.e. the Defendant) 

3.    That the Petitioner / Plaintiff after compromise does not want to pursue the said suit, rather wants / intends to withdraw the same, hence this petition.

4.    That as per law and in the interest of justice it is necessary that the case file of the said suit be recovered / summoned to record the statement of the Petitioner / Plaintiff for the withdrawal of the suit  on the basis of compromise.

5.    That the instant Petition has been filed to meets the ends of justice.

            It is, therefore, respectfully prayed that the case file of the above captioned suit may kindly be ordered to be recovered / summoned in order to record the statement of the Petitioner / Plaintiff of compromise and withdrawal the suit, to meets the ends of justice.
