GENERAL POWER OF ATTORNEY


KNOW ALL MEN BY THESE PRESENTS THAT We Mst. Hina Javed W/o Hamid Ullah Farooq and Huma Yaqoob both daughters of Haji Muhammad yaqoob (Late) R/o M-99, Mohallah Chohan Bazar, Rawalpindi, hereinafter called the executants.

            WHEREAS the predecessor of the executant  namely Haji Muhammad yaqoob S/o Haji Muhammad Ayub (Late) was the owner in possession of part of property No.M-99, Mohallah Chohan Bazar, Rawalpindi bearing portions No.M-99/89, M-99/5, M-99/8, M-99/15, M-99/18, M-99/22, M-99/36 M-99/40,   M-99/42, M-99/44, M-99/47 and two walls adjacent to passage of property No. M-27, as per compromise deed Exhibit-M-N, a part of judgment and decree dated 18.11.2006, passed by Raja Mohammad Ameer Javed, Civil Judge, Rawalpindi, in case titled “Chaudry Imran Asif  etc VS Haji Muhammad Saboor etc” .   

            AND WHEREAS the said predecessor of the executant (i.e. Haji Muhammad yaqoob) has expired on 23.01.2011 and after his death the executants and other legal heirs became the co-owner and co-sharer of the above mentioned Property to the extent of their respective share vide legal heir ship certificate / decree issued by Mr. Shaukat Mehmood, Learned Civil Judge, Rawalpindi vide judgment / decree dated 03.07.2011.

            AND whereas we the executant are personally unable to look after and manage the day to day affairs of the above said property to the extent of our share therefore, we the executant hereby appoint our real mother Mst. Aysha Yaqoob widow of Haji Muhammad yaqoob Resident of House M-99, Mohallah Chohan Bazar, Rawalpindi, Holding NIC No. 37405-0000000-0 as our GENERAL LAWFUL ATTORNEY to do the following acts deeds and thing in respect of property No. M-99/18 only which is part and parcel of property No. M-959, Mohallah Chohan Bazar, Rawalpindi, out of the above mentioned property, which she required from time to time.

1.    To look after and manage our shares in the above said property in all respects.

2.    To make sign, draw and execute any application / replication, statement, affidavit and to present the same in any office / corporation / department / court where necessary by representing us before authorities concerned.

3.    To sell, mortgage, pledge, gift, exchange, surrender and / or transfer the our share in the said property to any other person or party and to purchase stamp papers and get registered through any other lawful mode of transfer and to receive any amount / consideration through a legal and valid receipt in a lawful manner and to execute any of the above said Deed or document.

4.    To effect partition of the said property by metes and bound.

5.    To file any application including the ejectment petition / replication, written replication etc, to give statement / evidence in the competent court of law upto Supreme Court of Pakistan.

6.    To apply for and obtain any connection such as water, sui gas, electricity and telephone etc and to pay the bills to the respective quarters / departments and to obtain receipts of bills.

7.    To appoint further special attorney regarding the above said Land / Plot on our behalf in our name as and when required.

8.    To engage any advocate / counsel for legal assistance in case of any litigation, suit, review, revision, appeal, writ etc and their amendments if needed in respect of the above said property arising at any time and stage upto Supreme Court of Pakistan and to sign Vakalat Nama on our behalf and in our name. To appear in all competent courts of law / Tribunals  upto Supreme Court of Pakistan and to defend our rights in all such litigations regarding the above said property and in a lawful manner and to produce evidence orally or by documents as the matter may be and to submit any petition / Ejectment Petitions / application / replication, plaint / amended plaint,  written statement / amended written statement etc reply and all sort of their amendments in the court. To apply for and obtain any certified copy of any documents / paper from the copying agency / Revenue Department / Corporation or Board etc on our behalf and our name. To compromise and adjust our rights in all such litigations in respect of the said property in a lawful manner.

9.    GENERALLY our said attorney shall also be competent and authorized to do all other acts, deeds and things which she deems necessary from time to time and all acts done and things accomplished by said attorney shall be deemed be have been done by us personally and we confirm the same

10. To represent before any authority local bodies, offices of central and Provincial Government to sign any application, swear any affidavit on our behalf.

11. To all the other matters deeds and things which are necessary to be done and all the lawful acts, deeds, matters and things done by us said General attorney or shall be construed as having been done by us and we do hereby agree to rectify and confirm the same.
