SALE DEED


OF SHOP NO.  000 , Comercial Center, Satellite Town RAWALPINDI, MEASURING 24.3x5. 1½ (i.e 124.3 Sqft), WITHIN THE LIMITS OF ---, (--------), RAWALPINDI

            Know all men by these presents that we, (1) ABC (2) Mst. DEF, W/o HDEF, Son and Daughter of GHI (Late). (3) Mst. JKL, Widow of GHI, All resident of House No. 00 ,Street No. 00 Satellite Town, Rawalpindi, hereinafter called the VENDORS / EXECUTANTS (which expression shall include their legal heirs, representatives, successors-in-interest and assignees of the FIRST PART.


AND


(1) XYZ Son of FXYZ, R/o House No. 000, Street No. 00, Satellite Town, Rawalpindi, (CNIC No.00000-0000000-0) hereinafter called the Vendee (which expression shall include his legal heirs, legal representatives, successors-in-interest and assignees) of the SECOND PART.

WHEREAS Mr. GHI, S/o FGHI, was exclusive owner in possession of half a Shop No. 00, (alongwith Roof, common stairs and half portion of almiragh) situated at Comercial Center Satellite Twon, Rawalpindi, constructed upon land measuring 124Sqft and 3 inches vide Registered Gift Deed No. 1111 Book No. 01 Vol. No.22 page 333 additional Book No. 01 Vol No. 2222 pages 70-79 dated 02-08-1999, Registered with Sub Registrar (U), Rawalpindi, Surrender deed No. 22222 Book No. 01 Vol No. 33 pages 444 additional book No. 01 Vol No. 5555 Pages 99 - 151 dated 19-11-1999 registered with Sub Registrar (U) Rawalpindi, Surrender deed No. 3333 Book No. 01 Vol No. 44 pages 333 additional book No. 01 Vol No. 5555 Pages 450 to 490 dated 16-12-1998 registered with Sub Registrar (U) Rawalpindi, and the executants are also owner in possession of remaining half of almiragh i.e measuring 9.5 Sqf which is part and parcel of said shop, vide Surrender deed No. 444 Book No. 01 Vol No. 444 pages 250 additional book No. 01 Vol No. 3333 Pages 350 to 365 dated 11-05-2002 registered with Sub Registrar (U) Rawalpindi. The said GHI died on 25-02-2004 and after his demise the said half portion of Shop devolved upon his legal heirs i.e party of the 1st part (the executants/vendors), It is pertinent to mention here that said GHI was father and husband respectively, of party of the 1st part (the executants/vendors), and a decree for declaration of the heirship has also been passed by Mr. (Name of Judge), Learned Civil Judge, Rawalpindi on 10.01.2014.

            Whereas the executants / vendors of the first part are lawful owners in possession (as stated above) of above said half portion shop No. 00,  (alongwith Roof, common stairs and above said full almiragh) situated at Comercial Center, Satellite Twon, Rawalpindi and are fully entitled / empowered / authorized under the law to transfer / alienate the above said half portion shop along with roof, common stairs and above said full Almiragh in any manner whatsoever to any person / persons or party, and the above said portion shop is free from all sort of legal defect, objection, lien, encumbrances etc and now the said portion shop (fully described above) is hereby transferred by the Vendors / Executants i.e. the party of the first part with their free will and consent in favour of the Vendee, i.e, the party of the SECOND PART for a total consideration of Rs. 7,00,000/- (Rupees Seven Lac only) by way of this sale deed along with its physical possession and all the easement rights, in all respect, which is bounded as:-

                        North by         =          Passage 6 feet wide 
                        South by        =          Remaining half portion of shop No. 00
                        East by           =          Shop of UVW
                        West by          =          Street 20 feet wide

AND WHEREAS The Vendors / Executants of the first part have received the entire sale consideration of 7,00,000/- (Rupees Seven Lac only) from the Vendee / i.e. the Party of the SECOND PART at home in presence of marginal witnesses and the executants / vendors also undertake and acknowledge the receipt of the entire sale consideration of the above said portion of shop at the time of execution / completion of this sale deed before the Registration Authority and  WHEREAS the Vendee / Party of the  SECOND PART has now become the sole and absolute owners in possession of the above said portion of shop, free from any  sort of legal defect, lien / encumbrance etc.

AND WHEREAS the Vendee / Party of the second part has become the absolute owner in possession of the above said portion of shop and after the execution and completion of this sale deed and the Vendee / Party of the SECOND PART shall have lawful authority and liberty to further sell, mortgage, Waqf, pledge, gift, transfer in any manner whatsoever the said portion of shop to any other person or party to whom he likes and the first party or their legal heirs / representatives shall have no objection whatsoever in this respect.

AND WHEREAS the above said portion of shop is free from all sorts of legal defects and encumbrances, in case of any defect in the title of the party of the first part / executants / Vendors on account of which the Vendee shall undergo any loss, the party of the first part / Executants / Vendors shall make the loss good to the party of the second part i.e Vendee.

AND WHEREAS the possession of the said portion of shop fully described above has been delivered to the Vendee ( XYZ ) at the spot and now he has become the sole and absolute owner in possession of the same after the execution and completion of this sale deed.


IN WITNESS WHEREOF the Vendors / Executants of the first part have signed and subscribed this Deed of Sale at Rawalpindi on this _____day of ________ 2014.

             Execution and completion of this deed of sale has been admitted by the said executant, who subscribes to and abide by all the terms and condition set forth in the body of this deed.
