PETITION UNDER SECTION 25-A OF FAMILY COURT ACT 1964 FOR CONSOLIDATION / TRANSFER OF FAMILY CASES

PETITION U/S 25-A OF FAMILY COURT ACT 1964 FOR Consolidation / TRANSFER of  family cases


Respectfully sheweth:
  1. That the petitioners No. 2 & 3 are minors and they are filing the instant petition through their real mother i.e the petitioner No. 1, who has no adverse interest towards the said minors..
  1. That the petitioners have file a suit of the recovery of maintenance against the respondent which is pending adjudication before WXYZ the learned Judge, Family court Rawalpindi and is fixed for 26-10-2014 for the submission / filing of the written statement by the respondent /  defendant.
  2. That the respondent has also filed two suits for restitution of conjugal rights against the petitioner No. 1 which  are pending adjudication before Mr. PQRS  the learned Judge, Family Court Rawalpindi and Mr. MNOP the learned Judge, Family court Rawalpindi, respectively and both the said cases are  fixed for 09-12-2014.
  3. That as per law and in the interest of justice the family cases  between the same parties are the to be heard and decided by  any single learned judge in order to avoid the complications and contradictions in the judgment and also to save the precious time of the Honourable courts.
  4. That the instant petition has been moved to meet the ends of justice.

In view of the above it is most humbly prayed that all the said three suits of the parties for disposal, be entrusted / transfer  to a single learned Judge Family Court Rawalpindi, to meet the ends of justice.
