AN ACT
further to amend the Land Acquisition Act, 1894.
Preamble. | WHEREAS it is expedient further to amend the Land Acquisition Act, 1894 (Act No. I of 1894), for the purposes hereinafter appearing; |
It is hereby enacted as follows:—
Short title and commencement. | 1. (1) This Act may be called the North-West Frontier Province Land Acquisition (Amendment) Act, 1986. |
(2) It shall come into force at once.
Insertion of section 48A to Act No 1 of 1894. | 2. In the Land Acquisition Act, 1894 (Act No. I 1894), after section 48, the following new section shall be inserted, namely: |
Compensation to be awarded when land not acquired within one year. | "48A. (1) If within a period of one year from the date of publication of declaration under section 6 in respect of any land, the Collector has not made an award under section 11 in respect to such land, the owner of the land shall, unless he has been to a material extent responsible for the delay be entitled to receive compensation for the damage suffered by him in consequence of the delay. |
(2) The provisions of Part II of this Act shall apply, so far as may to the possible, to the determination of the compensation payable under this section.".
